China to Implement Export Controls on Lithium Batteries and Artificial Graphite Anode Materials

 

On October 9th, the Ministry of Commerce and the General Administration of Customs issued Announcement No. 58 of 2025, announcing the decision to impose export controls on items related to lithium batteries and artificial graphite anode materials (see attachment for the original announcement). The announcement will officially take effect from November 8th, 2025. Among them, substances related to lithium batteries include:

1. Lithium battery-related items

(1) 3A001 Rechargeable and dischargeable lithium-ion batteries (including cells and battery packs) with a weight energy density of 300 Wh/kg or higher (reference tariff code: 85076000).

(2) 3B901.a. Equipment used for manufacturing rechargeable lithium-ion batteries:

When exporting the aforementioned items, the export operator shall apply for a license from the competent commerce department of the State Council in accordance with regulations.

If the item falls under controlled items, it must be indicated in the remarks column of the customs declaration form as "dual-use item" and the export control code for dual-use items must be listed; if the item does not fall under controlled items but its parameters, indicators, performance, etc. are similar, it must be indicated in the remarks column of the customs declaration form as "not a controlled item" and the specific parameters and indicators must be filled in.

In accordance with the relevant provisions of the "Export Control Law of the People's Republic of China", "Foreign Trade Law of the People's Republic of China", "Customs Law of the People's Republic of China", and "Regulations on the Export Control of Dual-use Items of the People's Republic of China", and in order to safeguard national security and interests, fulfill international obligations such as non-proliferation, and with the approval of the State Council, it is decided to impose export controls on the following items:

1. Items related to lithium batteries

(I) 3A001 Rechargeable and dischargeable lithium-ion batteries (including cells and battery packs) with a weight energy density of 300 Wh/kg or higher (refer to tariff code: 85076000).

(II) 3B901.a. Equipment used for manufacturing rechargeable and dischargeable lithium-ion batteries:

1. Winding machine (reference tariff code: 84798999);

2. Folding machine (reference tariff code: 84798999);

3. Liquid injection machine (reference tariff code: 84798999);

4. Hot press;

5. Formation and capacity balancing system;

6. Capacity grading cabinet.

(III) 3E901.a. Technology used for producing items controlled under item 3A001.

II. Related items of cathode materials

(1) 3C901.a.1. Lithium iron phosphate cathode materials with a compaction density of 2.5 g/cm3 or higher and a gravimetric capacity of 156 mAh/g or higher (refer to tariff code: 28429040).

(II) 3C901.a.2. Precursor-related items of ternary cathode materials:

a. Nickel cobalt manganese hydroxide (reference tariff code: 28539030);

b. Nickel cobalt aluminum hydroxide (reference tariff code: 28539050).

(III) 3C901.a.3. Lithium-manganese-rich cathode material.

(IV) 3B901.b. Equipment for manufacturing cathode materials for rechargeable lithium-ion batteries:

1. Roller hearth kiln;

2. High-speed mixer;

3. Sand mill;

4. Airflow crusher.

III. Items related to graphite anode materials

(1) 3C901.b.1. Artificial graphite anode material.

(II) 3C902.b.2. Anode materials composed of a mixture of artificial graphite and natural graphite.

(III) 3B901.c.1. Granulation process equipment used for producing graphite anode materials:

a. Vertical granulation kettle with a granulation volume of 5 m3 or more;

b. Continuous granulation kettle with a granulation volume of 5 m3 or greater.

(IV) 3B901.c.2. Graphitization equipment used for producing graphite anode materials:

a. Box furnace;

b. Acheson furnace;

c. Internal furnace;

d. Continuous graphitization furnace.

(V) 3B901.c.3. Coating modification equipment for the production of graphite anode materials:

a. Fusion coating equipment with a capacity of more than 300 L;

b. Spray drying equipment with a volume greater than 60 m3;

c. Chemical vapor deposition (CVD) rotary kilns with a barrel diameter greater than 0.5 m.

(VI) 3E901.b. Process and technology for producing graphite anode materials:

1. Granulation process;

2. Continuous graphitization technology;

3. Liquid-phase coating technology.

When exporting the aforementioned items, the export operator shall apply for a license from the competent commerce department of the State Council in accordance with the relevant provisions of the "Export Control Law of the People's Republic of China" and the "Regulations on the Export Control of Dual-use Items of the People's Republic of China".

Export operators shall be responsible for the authenticity of the goods declared for customs clearance, strengthen the identification of export items, and if the items belong to controlled items, they must indicate "belong to dual-use items" in the remarks column of the customs declaration form and specify the export control code for dual-use items; if the items do not belong to controlled items but their parameters, indicators, performance, etc. are similar, they must indicate "do not belong to controlled items" in the remarks column of the customs declaration form and fill in specific parameters and indicators. If there are doubts about the completeness, accuracy, and authenticity of the above-mentioned information, the customs will question it according to law, and the export goods will not be released during the questioning period.

This announcement shall come into effect on November 8, 2025. The "Dual-use Items Export Control List of the People's Republic of China" shall be updated simultaneously.
